Format Magic - Terms and Conditions

These terms are written to be read. Each section starts with a short plain-English summary, followed by the full term. The full term is what applies.

1. Who We Are and Agreement to These Terms

In short: Format Magic is run by Format Magic Pty Ltd in Australia. Using the service means you accept these terms.

Format Magic is owned and operated by Format Magic Pty Ltd (ABN 64 681 504 030) ("Format Magic", "we", "us"). These Terms and Conditions govern your use of the Format Magic service at formatmagic.ai, including use without an account, with a free account, with a paid subscription, and through any API, connector, or integration we provide.

By accessing or using Format Magic, you agree to be bound by these terms. If you do not agree, please do not use the service.

You must be at least 16 years old to use Format Magic. If you are under 18, you may only purchase a subscription with the consent of a parent or guardian. If you use Format Magic on behalf of a business or organisation, you confirm you have authority to bind it to these terms.

2. The Service

In short: we use AI to turn your text into formatted documents. AI output is not perfect, so always review it before you rely on it.

Format Magic formats plain text into structured, professionally designed documents using artificial intelligence, based on the template you select. The service supports multiple languages and scripts.

Because output is produced by AI, it may occasionally contain errors, omissions, or unintended changes to your text. While the service is designed to preserve your content and only apply formatting, we cannot guarantee that every output will be complete or exactly faithful to your input. You are responsible for reviewing every formatted document before you use, send, or publish it.

3. Accounts, Plans and Usage Limits

In short: free and paid plans have usage limits, which are published on our pricing page and may change over time.

  • You may use Format Magic without an account, with a free account, or with a paid subscription. Each option has usage limits (such as characters per month and per request) as published on our pricing page.
  • We may adjust plan features and usage limits from time to time, including limits on the free plan. The limits shown on the pricing page at the time of use apply.
  • You are responsible for keeping your account credentials secure and for all activity under your account. Accounts are for a single user and must not be shared or resold.
  • You can manage upgrades, downgrades, and cancellation from your account settings.

4. Billing, Renewals and Refunds

In short: subscriptions renew automatically until you cancel. Cancelling stops the next charge. Your rights under Australian Consumer Law always apply.

  • Paid subscriptions are billed in advance on a recurring basis and renew automatically until cancelled. Payments are processed by our payment provider (Stripe); we do not store your full card details.
  • You can cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period, and you keep your paid features until then. We do not provide pro-rata refunds for partly used billing periods, except where the law requires otherwise.
  • If a renewal payment fails, we may retry the charge and notify you. If payment cannot be collected, your account may be downgraded to the free plan.
  • Unused monthly allowance does not roll over between billing periods. One-time character purchases are drawn down as you use them and are not refundable once consumed, except where the law requires otherwise.
  • We may change subscription pricing. Price changes for existing subscribers take effect from the next billing period after we give you reasonable notice.
  • Nothing in these terms excludes your rights under the Australian Consumer Law, including consumer guarantees and remedies for services that are faulty or not as described.

5. Your Content

In short: your text and documents stay yours. You give us permission to process and store them so the service can work, and you are responsible for having the rights to what you upload.

  • You retain all ownership rights in the text, files, and images you submit and in the content of your formatted documents.
  • You grant us a limited licence to host, process, store, and display your content solely as needed to provide the service: to format your text, to save documents and templates you choose to keep in your account, and to display documents you choose to share.
  • Text submitted for formatting is retained only as long as needed for processing, as described in our Privacy Policy. Documents and templates you choose to save remain stored in your account until you delete them or close your account.
  • If you share a document using a share link, anyone with that link can view it. Sharing is your choice and your responsibility.
  • You warrant that you have the necessary rights to the content you submit, and that it does not infringe anyone else's intellectual property or other rights.

6. Our Intellectual Property and Your Licence to Use It

In short: the platform, templates, and designs are ours. You can freely use the documents you create for your own purposes, but you cannot copy, extract, or resell the templates or designs themselves.

The Format Magic platform, including its software, templates, document designs, styles, prompts, branding, and related technology, is the intellectual property of Format Magic Pty Ltd and is protected by copyright and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable licence to use the service and its templates to create formatted documents, and to use, share, and distribute those documents for your own personal or business purposes. This includes commercial use of your own documents.

This licence does not permit you (or anyone acting for you) to:

  • copy, extract, reproduce, distribute, sell, or license the templates, document designs, styles, or prompts themselves, whether directly or by recreating them from generated output;
  • use the service, or output generated by it, to build, train, or improve a competing product or service, or to assemble a collection or dataset of our templates or designs;
  • remove or alter any proprietary notices, or represent our templates or designs as your own work product for resale.

To be clear: the distinction is between your documents (yours to use freely) and our templates and designs (ours, licensed to you only for creating your documents).

7. Acceptable Use

In short: use the service lawfully and fairly. No scraping, bulk automated extraction, or abuse.

You agree not to:

  • submit content that is illegal, infringing, or intended to harm others;
  • scrape, crawl, or harvest any part of the service, or make excessive or bulk automated requests beyond normal use of published interfaces;
  • attempt to bypass usage limits, security measures, or access controls, including by creating multiple accounts;
  • reverse engineer, decompile, or attempt to extract the source code, prompts, or template definitions of the service;
  • resell, sublicense, or provide access to the service to third parties as a service of your own;
  • interfere with the operation of the service or impose an unreasonable load on our infrastructure.

These rules apply equally to use of the service through any API, connector, or integration. We may suspend or terminate accounts that breach this section.

8. Privacy and Data

In short: how we handle your data is set out in our Privacy Policy. We use trusted third-party providers to deliver parts of the service.

  • Our collection and handling of personal information is described in our Privacy Policy, which forms part of these terms.
  • We use industry-standard encryption to protect data in transmission.
  • We use third-party providers to deliver parts of the service, including AI processing (such as Google Gemini and OpenAI), payments (Stripe), sign-in (Google), email delivery, and document conversion (Adobe PDF Services for PDF-to-Word conversion). Content is sent to these providers only as needed to perform the requested function, and your use of those functions is also subject to the relevant provider's terms.

9. Service Changes and Availability

In short: we improve the service continuously and aim for high availability, but we do not guarantee uninterrupted access.

  • We may add, change, or remove features of the service at any time, including templates and plan features.
  • We aim to keep the service available at all times but do not guarantee uninterrupted or error-free operation. The service may be temporarily unavailable for maintenance, updates, or reasons outside our control, including outages of third-party providers.

10. Suspension and Termination

In short: you can close your account at any time. We can suspend or close accounts that break these terms.

  • You may stop using the service and close your account at any time.
  • We may suspend or terminate your access if you materially breach these terms (including the acceptable use and intellectual property sections), if required by law, or to protect the service or other users. Where reasonable, we will notify you and give you an opportunity to remedy the breach.
  • If your account is closed, your saved documents and templates may be deleted. We recommend downloading anything you want to keep before closing your account.
  • Sections of these terms that by their nature should survive termination (including intellectual property, disclaimers, liability, and indemnity) continue to apply.

11. Disclaimers and Limitation of Liability

In short: the service is provided as-is and our liability is capped, except for rights the law does not allow us to limit.

Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law or other applicable law that cannot lawfully be excluded.

Subject to that:

  • the service is provided "as is" and "as available", and we make no other warranties about accuracy, reliability, or fitness for a particular purpose;
  • you are responsible for reviewing formatted documents before relying on or distributing them, and we are not liable for losses arising from use of unreviewed output;
  • we are not liable for indirect or consequential loss, loss of profits, loss of data, or loss of opportunity;
  • our total aggregate liability arising out of or in connection with the service is limited to the greater of the amount you paid us in the 12 months before the event giving rise to the claim, or AUD $50;
  • where liability under a non-excludable guarantee can be limited, it is limited to re-supplying the service or paying the cost of re-supply.

12. Indemnity

In short: if your content or misuse of the service causes a legal claim against us, you cover the cost.

You indemnify Format Magic Pty Ltd against any claims, losses, and expenses (including reasonable legal costs) arising from content you submit, your breach of these terms, or your misuse of the service, except to the extent caused by our own breach or negligence.

13. Changes to These Terms

In short: we may update these terms and will let you know about significant changes.

We may update these Terms and Conditions from time to time. The "Last Updated" date at the top shows when they last changed. We will notify you of significant changes via the website or email. Your continued use of the service after changes take effect constitutes acceptance of the updated terms. If you do not agree to a change, you should stop using the service and may cancel your subscription.

14. Governing Law and Disputes

In short: these terms are governed by the law of Western Australia. Talk to us first if there is a problem.

These terms are governed by the laws of Western Australia, and you and we submit to the non-exclusive jurisdiction of the courts of Western Australia and the Commonwealth of Australia. If a dispute arises, please contact us first via our contact form so we can try to resolve it directly. This section does not limit any rights you have under the Australian Consumer Law or, if you are outside Australia, any mandatory consumer protections in your own jurisdiction.

15. General

In short: standard legal housekeeping.

  • If any part of these terms is found to be invalid or unenforceable, the rest continues to apply.
  • These terms, together with the Privacy Policy and the plan details on our pricing page, are the entire agreement between you and us regarding the service.
  • We may assign our rights and obligations under these terms in connection with a restructure or sale of our business. You may not assign yours without our consent.
  • A failure by us to enforce any part of these terms is not a waiver of our right to enforce it later.
